Yesterday, OR-OSHA adopted a temporary wildfire smoke rule that will have significant impacts on Oregon employers. The new rule affects employers whose employees work predominantly outdoors as well as those that work indoors. Employers must comply with the new rules beginning at Air Quality Index (AQI) levels that exceed 101, with additional compliance requirements in situations where AQI exceeds 201 and 500. The rule is effective beginning on August 9, 2021.

You can view a copy of OR-OSHA’s temporary rule here. Temporary rules may remain in place for a maximum of 180 days. OR-OSHA is expected to consider adoption of a permanent rule at a later date.
